Congratulations on your upcoming trade_show event PGA Awards located at Hollywood Bowl to be held on February 29, 2024 ending on February 29, 2024 at [event-end-time]*
MOVE-IN & MOVE-OUT DETAILS
We will schedule move-in at [move-in]* on [move-in-date]* and have scheduled move-out time at [move-out]* on [move-out-date]*
The contracted total for your event is [contracted-total]. We must receive a signed agreement by [contract-due-date]. In order to begin work in a timely manner we require a deposit in the amount of [deposit-amount] and this is due on [deposit-due-date]. Invoices are payable by cash, wire transfer or Zelle.
Please note that any payments made after their due date may require an additional cost. It is at our sole discretion to make changes and/or adjustments. Mr Foam and Scenic is not responsible for late payments and we have the right to cancel production on your event/job.

THE LEGAL STUFF (TERMS AND CONDITIONS)
By agreeing to our terms and conditions you herby agree that we (Mr Foam and Scenic and its' affiliates) are not responsible for:
1. Contract becomes valid only when signed and returned by client.
2. Contract is valid rain or shine: in the event of rain during an outdoor event, compliance is at the sole
discretion of the contractor. We reserve the right to make changes and/or accommodations per job. Safety is always our first concern.
3. In the event of postponement or cancellation, the deposit is NON-REFUNDABLE
4. In the event Mr Foam and Scenic fails to comply with the terms of this contract, due to any event or act outside and beyond our control, our liability is limited to a refund of the deposit ONLY
5. BALANCE IS DUE 3 DAYS PRIOR TO EVENT. NO EXCEPTIONS!
6. If cancellation of the event is made less than 2 months prior to the event, liability of the client for breach of agreement shall be a sum equal to the agreed total price.
7. In the event it becomes necessary for Mr Foam and Scenic to retain legal counsel in order to collect monies owed to Mr Foam and Scenic due to a breach of any of these contractual obligations, the client hereby agrees to pay any and all reasonable attorney and legal fees at both the trial and appellate levels.
8. Photographs and videotapes taken by or provided to Mr Foam and Scenic become the property of Mr Foam and Scenic and we reserve the right to use the aforementioned media for promotional material, including any form of social media, and for viewing by prospective clients.
9. ENTERTAINMENT ONLY: Request for or specification of any performer of Mr Foam and Scenic is subject to the availability of that performer on the day of the event. Mr Foam and Scenic cannot be held responsible for circumstances beyond our control. Such specifications shall be a REQUEST only and NOT a guarantee. All possible measures shall be taken to honor such requests. This agreement is specifically NOT conditioned upon such a request.
10. EVENT START TIMES: In the event that show producer or event decides to begin at a different time than the original time Mr Foam and Scenic has the right to charge for overtime or extra time depending on event. This is case by case basis.
11. LATE PAYMENTS: will incur additional fees. Due to fluctuations in raw materials, labor, transportation, weather and circumstances beyond our control we must may not be able to produce your event without receiving payments on time. This is highly critical as we do our best to give you the best pricing. Anything outside of these parameters will incur additional costs.
12. LATE / MISSING MATERIALS: materials delivered outside of our control fall under the responsibly of each carrier unless we are supplying logistics and transportation for your materials. For shipments outside of our scope ie: FEDEX, UPS and third party logistics companies our liability is exempt.
13. CREDIT CARD PAYMENTS: For custom booths and/or events not listed in our shopping area credit card payments will incur require a 3.5% fee for the total contracted amount. Charge backs in excess of $1,500 USD require approval from Mr Foam and Scenic management. By signing this contract you agree that you will contact Mr Foam and Scenic before any requests can be made to your credit card company. No exceptions.
14. MOVE IN / MOVE OUT*: Mr Foam and Scenic will install and remove your event materials as per show requirements and our contracted obligations. At certain times there may be changes to dates and times. We will do everything in our power to adhere to exact deadlines. For issues beyond our control our team will work with you, the show producer (and or venue) to make adjustments. This is on a case by case basis.
Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site and or services

You and the Site agree that we may access, store, process, and use any information and personal data that you provide following the terms of the Privacy Policy and your choices (including settings).
By submitting suggestions or other feedback regarding the Site, you agree that we can use and share such feedback for any purpose without compensation to you.
We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site. You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.
